Simba Products, Inc., Warranty PolicySimba Products instruments are warranted to be free from defective materials and craftsmanship for 180 days from the date of purchase to the original purchaser when purchased from an authorized dealer subject to the limitations contained herein. This warranty is non-transferable and is applicable solely to the original purchaser in the United States and Canada. Simba Products, Inc. will repair or replace, at its option, any Simba Products instrument or part thereof which is found by Simba Products to be defective. Electronic controls are covered for a period of 90 days. Simba Products, Inc. reserves the right to use materials readily available at the time of the repair.
What is covered against manufacturing defects:
Parts and Labor to correct any defect in materials used and any defect attributable to workmanship.What is not covered:
No Other Warranties:
- Instruments that have been modified from their original condition.
- Instruments whose serial numbers have been altered or removed.
- Instruments that have been subjected to extreme humidity or temperature conditions.
- Defects or damage caused by services performed by unauthorized persons (service by anyone other than Simba Products or an Authorized Service Center)
- Instruments that have been damaged due to misuse, neglect, or accident. .
- Normal wear and tear to serviceable parts such as strings, tuning machines, drumheads, sticks, electronic controls and frets.
- Instruments that have not been purchased from an Authorized Simba Products instruments dealer.
- Warranty claims by anyone other than the original purchaser.
- Freight charges to and from the factory or authorized service center for customer owned goods.
- Any and all charges incurred from priority service requests (Rush Service) or priority shipping for replacement parts.
- Alleged Defects concerning the subjective opinions or judgments of the original purchaser
- Simba Products shall not be liable for any indirect, incidental, or consequential damages, including but not limited to, wages or lost profits of any nature or kind or for damages to or loss of property suffered by the original purchaser or any third party, whether in contract or in tort.
The Limited Warranty set forth herein constitutes the entire warranty and representation of Simba Products with regard to its instruments. This Limited Warranty shall be controlling over any conflicting terms and conditions of any purchase orders, contracts or invoices that may be executed in connection with the purchase of a Simba Products instrument. No oral or written representation made by a dealer, agent, representative or employee shall be binding upon Simba Products. Simba Products makes no other express warranty of any kind. ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXCEEDING THE SPECIFIC PROVISIONS OF THIS WARRANTY ARE HEREBY DISCLAIMED AND EXCLUDED FROM THIS WARRANTY.Claim Procedures:
Claims for warranty service shall be made by sending the instrument, shipping and insurance prepaid by the purchaser, to Simba Products or an Authorized Service Center together with: (a) evidence confirming the date of the original purchaser and the name of the original purchaser (a copy of the sales invoice, receipt, credit card slip, or other satisfactory documentation); (b) a brief description of the nature of the asserted defect; and (c) name, address and phone number of the person to whom the instrument is to be returned. After reviewing the claim, Simba Products shall make service, repairs and replacements as deemed appropriate under this Limited Warranty. Upon completion of the warranty service, Simba Products shall return the instrument to the original purchaser, shipping and insurance to be paid by the purchaser. In the event Simba Products determines the asserted defect is not covered by or is excluded from this Limited Warranty, the instrument shall be returned to the original purchaser without repairs or replacement, shipping and insurance to be paid by the purchaser.
